FOCUS OF PRACTICE
     David is a successful litigation and transactional attorney with a broad combination of legal and technical skills in patent, trademark and trade secret litigation; Inter Partes Review (IPR) proceedings; strategic patent portfolio management and prosecution; product clearance; invalidity and non-infringement opinions; technology licensing, as well as confidentiality and joint venture agreements. David is also a certified mediator and can be engaged as a neutral-mediator to aid parties in finding a resolution to their dispute outside of the courtroom.

  • Involved in numerous bench and jury trials as well as appeals to the U.S. Court of Appeals for the Federal Circuit

  • Involved in many post-grant proceedings such as IPR proceedings
  • Secured numerous favorable litigation resolutions, including multi-million-dollar damages awards for plaintiffs
  • Secured multiple take-nothing walk away agreements and early stage summary judgment rulings for defendants
  • Member of the Texas State Bar Advanced Patent Litigation Planning Committee, 2014-2017
  • Member of the American Bar Association Patent System Policy Committee, 2011
  • American Bar Association Vice-Chair for the Special Committee on Biotechnology, Chemistry, Medicine and Pharmacology, 2010-2012
  • Obtained Early Stage Summary Judgment of Non-Infringement for client in the Northern District of California
  • Successfully settled a dispute with the Business Software Alliance (“BSA”) on behalf of client for a small fraction of the BSA’s original damage assessment
  • Instituted company-wide intellectual property protection programs for several major oil field services companies
  • Presented multiple CLE presentations in corporate and academic settings, covering a wide variety of intellectual property related topics including: prefiling considerations in patent litigation, electronic discovery, false marking, trade secret protection programs, patent prosecution and inequitable conduct
